| In order to crack criminal cases as soon as possible and save the judicial resources, combinedwith the actual situation in our country, China uses the criminal reward as an effective way to crackcriminal cases. Criminal reward has been implemented for more than30years since it was first used inChina. However, because China has not paid enough attention to the system, coupled with lack ofunderstanding to this system, criminal reward has not formed a complete system of norms, which hascaused some confusion in practice. Therefore, the author puts forward some specific systemconstruction ideas in order to promote our country criminal reward system establishment.This thesis is divided into three parts.The first part discusses the necessity for constructing the criminal reward system in our country.The paper analyzes the basis of existence of criminal reward system from different angles: theestablishment of the criminal reward system is in line with the economic, legal, and some basicprinciples of judicial policy, which are the necessity of its existence.The second part analyses the current problems of criminal reward in China. There are mainly sixproblems in China’s criminal reward: the nature of criminal reward, the scope of the criminal reward,the reward standard of criminal reward, the subject of criminal reward, the relative person in criminalreward and the lack of protection of criminal reward for the informers’ rights and interests.The third part puts forwards the preliminary opinions for constructing our system of criminalreward. Starting from the definition of the nature of criminal reward, determining the scope of criminalcases of criminal reward, specifying the related problem of the bounty of criminal reward system,coordinating the relationship between criminal reward system and folk reward system, explicating therange of the other party in the criminal reward and strengthening the protection of the informers’ rightsand interests in criminal reward system. By referring to foreign experience and combining with ourcountry’s judicial practice, this paper explores tentatively the construction of the criminal reward systemin our country. |
