On The Research Of Current Situation And Countermeasures For The Public In China Participating In Administrative Hearing

Public participation in administrative hearing is a concrete embodiment of democracy development and implement of democratic administration. It plays an important role in ensuring the government legitimacy, improving government efficiency and credibility, promoting the administration in accordance with the law, promoting the scientification and democratization in government policy-making, safeguarding the public interests, meeting the needs of public participation in politics and developing the public’s consciousness of participating in politics. But according to current situation, there are still some problems restricting the public to participate in the administrative hearing, such as lack of awareness and ability to participate in administrative hearing, institutional imperfection of administrative hearing, and role reversal of organization to hold administrative hearing. Therefore, in order to solve foresaid problems, avoid making the public participation in administrative hearing a mere formability and make the administrative hearing function well, this thesis mainly seeks out reasons resulting in the problems and puts forward related measures on the premise of sorting out the basic circumstance of public participation in administrative hearing. In the thesis, chapter one mainly introduces the research background, significance, purposes, overview, details and methods. Chapter two expounds the concept, theoretical foundation and significance for public participation in the administrative hearing. Chapter three demonstrates the basic situation of the public participating in administrative hearing in the order of stages holding hearings and in the way of investigation. Chapter four generally applies the methods of document and theoretical analyses to point out the deficiencies of public participation in administrative hearing and its reasons. Chapter five bases on the theoretical analysis and practical experience to put forward strategies to promote the public in China take part in the administrative hearing from three aspects of the public, institution and government.
