The Faultiness And Rebuilding Of Representative System Of Public Price Hearing

Price hearing system comes from the "Pricing Law" enacted in1997, the provisions of Article23of the Act:"to make a desition of price adjustment which related to the people’s vital interests such as utility prices, public welfare services prices and the commodity prices of natural monopolies, shall establish a system of hearings, presided over by the government price departments to solicit the views of consumers, operators and interested parties, explore the necessity and feasibility. Of course, the price hearing system is not established in one day, its shape can be traced back to the1990s, launched by the Shenzhen Municipal Government price Advisory Committee. Abroad, relative to other hearings type, public price hearing is not common, relative to China for less. It contains the reasons in economic system, but also historical reasons. In short, China’s public price hearing system is not original, is draw on the experiences of the Western administrative hearing system, but also has its own characteristics.The public price hearing system has gone through close to fifteen years since1998when the pricing Law was implemented. In the course of implementation, there has been a lot of problems. Although the public price hearing system have continued to improve and development,but in recent years, the specialized households of representative in public price hearings constantly hit the newspapers, these phenomena make people have to look again at this system.The phenomena of the specialized households of representative in public price hearings occurred, mainly due to the faultiness of Representative System of Public Price Hearing. The hearing representative system is an important part in the public price hearing system, the design of this system directly determines the success or failure of the entire public price hearing system. This paper will analysis the phenomena of hearing specialized households, based on Representative System Of Public Price Hearing, intend to find a way to solve the problem through rebuild this system.This paper consists of four parts. The first part put forward the thiesis,analysis the the phenomena of "every price hearing will rise" from the perspective of the status of the implementation of China’s current public price hearing system, and expounded the necessity and urgency to improve the public price hearing system. The second part make theoretical analysis of, Representative System Of Public Price Hearing, combined with the foreign country’s administrative hearing system compared with us, also analysis the function and value of the Representative System Of Public Price Hearing. The third part is about the short board of the Representative System Of Public Price Hearing in our country, analysis its deficiencies and defects. The fourth part is about the rebuiling of the Representative System Of Public Price Hearing, put forward my view of rebuild this system based on the problem of it, intend to improve the presentative system of public price hearing system.
