Citizens with the growing aging population, especially the elderly often sufferfrom the disease attacks and even suffer from an incurable disease. Due to theunbearable pain, and current status of law, makes a significant portion of patients willdie in a recessive state. But from the recent "euthanasia" case, the recessive statecannot fully safeguard the legitimate rights and interests of patients, even there will beother drawbacks. Thus appear increasingly important for the euthanasia legislation,however, because euthanasia involves medicine, law, sociology, ethics and so onmany aspects and arguments is bigger, so the scholars disagree about whethereuthanasia should be legislation. Accordingly, should how to euthanasia legislation,and how the legislation is the key issues discussed in this paper.In this paper, the text is divided into four parts, the first part mainly put forwardthe question of legalized euthanasia. Including the concept of euthanasia andcharacteristics, the classification of euthanasia and the status quo of euthanasia indifferent countries. First of all, it introduces the concept, characteristics andeuthanasia classification are discussed in this paper. Secondly, this paper introducesthe national legislation and practice of death. By "euthanasia" case happened inmainland China, and real life’s attitude towards euthanasia, points out the necessity oflegalization of euthanasia in our country.The second part of the article introduces academic debate about the ethics ofeuthanasia. Ethical community debate on euthanasia mainly reflects in the life values,family ethics and medical ethics from three aspects. First in terms of life values, alongwith the social development the idea of people are also changing, life is not only aliveshould be live with more valuable quality. Secondly in terms of family ethics,euthanasia from the perspective of terminally ill patients solve their intolerable pain,more in line with the essence of the humanitarian spirit. Respect for patientsthemselves, their own will to die let the piece also accord with the traditional filialpiety. Again, the modern medical ethics should not only recognize the medicine treating patients, patients should also reduce the pain.The third part of the article is to discuss euthanasia law. First of all, according tothe relevant analysis indicates that euthanasia does not constitute a crime criminal lawtheory. Second, the limited power of euthanasia is essentially belongs to the right oflife. Through the analysis of the dominion over the right to life can be, it is pointedout that the right to life with limited dominant, to demonstrate individual under certainconditions the right to choose death. Finally, starting from the essence of man thatpersonal dignity and free will are necessary to man as a person. Patients seekeuthanasia is to maintain their dignity, is the exercise of free will.The fourth part of the article is about euthanasia system design ideas. This chaptermainly from euthanasia in the application system, examination system, executionsystem, supervision system for the design. Although to euthanasia legislative councilthere are some negative phenomena, but it’s not euthanasia itself, any things arealways two sides to everything, believe us from the real condition and processconditions on the regulation, will better play to the value of euthanasia.
