Research On The Legal Mode Of Protection Of Chinese Traditional Martial Arts From The View Of Non-material Cultural Heritage

A large number of traditional martial arts are listed in national intangible culturalheritage and regional intangible cultural heritage which are previously announced. Theyhave made a great contribution to inheriting the excellent traditional culture, such asShaolin kung fu, shadowbox. But the inclination of attaching importance to art exists inthe protection of intangible cultural heritage seriously. Traditional martial arts did not getattention they deserved and risked being marginalized, which can be seen in the categoryof the intangible cultural heritage list the traditional martial arts belong to. The traditionalmartial arts face the plight of inheritance and protection with the development and changeof our society. At present, traditional martial arts need to establish a set of protectionsystem. Legal protection is the basis and core of inheritance and protection of traditionalmartial arts. Therefore, it is necessary for us to research the problem of legal protection oftraditional martial arts of China.This thesis is divided into5parts, the main contents are as follows:The introduction and the first chapter is the background. They discusses presentresearch status and background of traditional martial arts. The second chapter is theanalysis of legal relationship of traditional martial arts. This part mainly analyzes fromthree aspects: subject, object and content. The third chapter is the legal protection mode oftraditional martial arts. This part demonstrates the necessity of legal protection of Chinesetraditional martial arts and then it demonstrates the legal protection mode of Chinesetraditional martial arts from the administrative protection and civil protection in twodimensions. The fourth chapter constructs and perfects the legal protection system of thetraditional martial arts in China in three parts. The first is the principle and idea ofprotection. It gives suggestions and improvement from the view of intellectual propertyprotection system and administrative protection system.
