Research On The Legal Protection Of Traditional Martial Arts

Traditional Wushu is an important traditional culture and intangible cultural heritage of our country.It is also an important work of folk literature and art.Today,with the acceleration of global integration,competition between countries has shifted from traditional territory,natural resources and other fields to cultural fields.As a kind of resource,traditional culture can be transformed into cultural products through the capitalization of the market,which contains huge development potential and commercial value.Agenda 21 of the United Nations for Sustainable Development separates cultural property rights from intellectual property rights.The proposal of cultural property rights means that traditional culture can establish exclusive private rights.As an irreplaceable traditional cultural resource in China,traditional Wushu has been exploited and utilized unreasonably by domestic and foreign businessmen since the end of last century,and even distorted the cultural image of traditional Wushu.The proposition of cultural property rights provides a theoretical basis for the protection of property rights of traditional Wushu in China.By analyzing the legal protection modes of traditional cultural heritage in other countries,this paper conducts a comprehensive and in-depth study on the legal protection of traditional martial arts in China,and tries to combine the administrative legislation protection in the field of public law with the protection of intellectual property law in the field of private law,and endow the right owners by clarifying the identification of the right subjects,the object of rights and the scope of the content of rights.We should explore the legal protection mode suitable for Chinese traditional Wushu,improve the legal protection system of Chinese traditional culture,promote the inheritance and development of traditional Wushu and the prosperity of traditional culture.
