The Application And Perfection Of Technical Investigation Measures About Duty Crime

In the revised "Criminal Procedural Law",the "technical investigation measures" are singled into section separately,It make the principle rules and instructions.It explicitly gives the power of the technical investigation in the investigation of duty crime cases to Procuratorial organs.This is the first time in the legislative history of criminal procedural law in our country,and new requirements are put forward to the duty crime investigation,in the new period it is faced with new opportunities and challenges to duty crime investigation too.In this paper,it is deeply explored and researched to the concept of duty crime investigation technology,the characteristics of technical investigation,the types of investigative measures,the development and application of technical investigation measures,the function and existing problems of technical investigation measures in duty crime investigation.And the same time,combined with the judicial practice in our country,learning from foreign mature technical investigation measures,some ideas and suggestions are put forward to perfecting the function of our country's technical investigation measures in legislative mechanism.This paper includes three parts: introduction,body and conclusion.The body is the main part,which is composed of five parts.In the first two parts,it is introduced to the concept characteristics and classification of duty crime investigation technology,and to the function of technical investigation measures in duty crime investigation.The third,fourth,and fifth parts are the focus of this paper,in these parts,firstly the application of technical investigation measures in duty crime is introduced,including the development of the technical investigation measures applied,the legal basis and principle of technical investigation measure's specific application in duty crime investigation,etc.On the basis of the above,it is introduced to three problems of duty crime in applicating the technical investigation,including how to perfect legislation regulation,improve systems and mechanisms,act comprehensive functions in duty crime technical investigation.The fifth part is about ideas and suggestions to perfect the technology investigation in duty crime.Three suggestions are proposed corresponding to three questions above,which are the perfection of legislation regulation,improvement of systems and mechanisms,acting of comprehensive functions in duty crime technical investigation.
