Legal Construction Of The Universities Operational Mechanism Under The Background Of Institutions Reform

In the era of knowledge economy，the core of the economic competition is mainlyreflected in the development of technology and personnel training， universities providerelatively free space for knowledge creation，we must optimize the organizationalstructure，the management pattern and the system mechanism, enables the academicauthority to display its superiority.How is the status of the operational mechanism of universities? What is thedifference of the operational mechanism of universities in China compared with foreigncountries? How to balance the powers of the different levels of universities? These areproblems that are worth exploring.Since reform and opening up，although our country tertiary education has carriedout a series of management structural reform， but is not yet complete， theimplementation of the "Higher Education Act" is not enough in place，and the focus ofreform is more for the division of powers between all levels of government anduniversity and the school’s leadership structure adjustment，not enough emphasis onacademic power and administrative power allocation，attention is not enough.This article firstly described the concept of operational mechanism，combined withthe background of the institutions reform，analysis of operation mechanism of universitystatus，compared with the overseas university’s operational mechanism，proposed achange，adjustment of related strategies，to achieve a harmonious state of thought andaction. At present，the study on the operational mechanism of universities，focused onthe administration, with few legal level，this study also has far-reaching significance.
