Research Of Legal Regulation On Anticompetitive Behavior Of Enterprise Group

With the rapid development of economy in our country, the enterprise group hasbecome a common economic phenomenon, more and more enterprises adopt it. Enterprisegroup is able to expand the scale of enterprise assets and business, open new business areas.And it will also be able to balance the profit and loss between enterprises, avoidprogressive rates. But the emergence of enterprise group, will bring challenges to ouranti-monopoly. Because enterprise group can impede effective competition order bymaking a deal of limiting competition, abusing of market ascendancy, merging. But thereis no explicitly stipulated about enterprise group in our anti-monopoly law. And there is noexplicitly stipulated about which behavior of restricting competition will be regulated ornot. So research on enterprise group of limiting competition behavior will has a certainpractical significance in both academic and practice.We will analysis enterprise group through four parts in this paper. In the first part, wewill start from the concept of enterprise group to have a comprehensive understanding ofenterprise group, so as to lay the foundation for other parts. In the second part, we willstudy the regulation of anti-monopoly to enterprise in our country, and find some problems.In the third part, we will study the regulation of anti-monopoly to enterprise in othercountries, and use their mature experience to perfect our country anti-monopoly law. Inthe fourth part, on the basis of the former three parts, we will make advice of perfectingour country anti-monopoly law to regulate enterprise group.
