The Improving of Immunity System of the Criminal DefenderThe creation and existence of the system of criminal advocacy have a profound philosophical foundation, but the barrister has to burden certain professional risk in collecting evidence when he pleads criminally. At Present, many countries have endued the lawyer with the immunity from criminal responsibility; so it is realistic and wise to endow lawyer with the right of immunity in criminal defense in China.This article contains three parts. Part one:through analyzing the lawyer working environment and researching on the establishment experiments of immunity system in western countries, the article has tried to give a clear definition in immunity system of the criminal defense, and it is essential for China to improve the immunity system. Part two:trying to study the cultural reasons and national situations, this part has given a comprehensive view of the lack of immunity system of the criminal defense. Part three:has proposed the improvement methods and restriction measures to the immunity system in criminal defense.
