Research On The Patterns Of Insurance Fraud Crime

This paper is composed of foreword, text and conclusion. The foreword part gives a brief introduction on suspended forms of insurance fraud crime, namely the criminal cessation pattern and the joint crime pattern. The text part starts with the exemplary cases of the crime of insurance fraud and existing controversies. Then it discusses the legal analysis about the criminal patterns of the crime of insurance fraud and its joint crime pattern. At the end the text part presents the author’s opinion about the identification for the crime patterns of the crime of insurance fraud.In the first chapter of the text, exemplary cases of the crime of insurance fraud and existing controversies about the crime patterns are introduced.In the second chapter, suspended forms including preparation, completion, attempted and abandonment are legally analyzed one by one. Linked with judicial theory and practices about the crime of insurance fraud, the text explores the controversies which are raised in the first chapter and comes up with the author’s own view.In the third chapter, the joint crime pattern is attached the importance to. Considering the complexity of the suspended form, completion and unfinished form of the joint crime pattern of the crime of insurance fraud, this chapter only analyzes the suspended forms of simple joint crime pattern, discussing the identification of the joint crime pattern.In the fourth chapter, the text attempts to analyze, discuss and identify kinds of suspended forms of the crime of the insurance fraud in accordance with the fundamentals of China’s judicial theory and practices of the Criminal Law and the Law of Insurance. It aims to help identify kinds of suspended forms of the crime of insurance fraud in practice.At last, the conclusion part summarizes this paper and offers the significance and flaws of this paper.
