With the development of the insurance industry,the problem of insurance fraud is more and more serious.Insurance fraud is not only caused against the property of the insurer,but also poses a huge threat to the stability of the insurance market.The existing laws and theories have been unable to regulate the complex and diverse insurance fraud,The immaturity of the theory of insurance fraud has caused some difficulties in judging the crime in judicial practice.In view of this,This article focuses on solving the problem of the determination of the crime of insurance fraud in judicial practice,Through the comparative study,the method of analysis and argumentation is used to study the special behavior of insurance fraud,the crime form of insurance fraud,the accomplice of crime of insurance fraud and the difference between insurance fraud and other crimes,hope to have a reference to the practice of justice.
