With the multiple development of globe economic and the implement of national marinestrategy, many countries becoming pay more attention to the utilization of uninhabited islands.But during the exploit process, several administrative vulnerabilities lead to random exploitphenomenon become more serious, such as, relaxed approval procedure, the lack of legalprovision and imperfection of relevance legal systems. In order to guarantee the sustainabledevelopment of uninhabited islands, our country needs to take some legitimate measures tomanage and protect islands.This paper mainly talks about the research on the law of uninhabited islands protectionfrom five aspects. First, the instruction part mainly presents the background and significanceof the research on the law of uninhabited islands protection. The paper particularly analyzingthe current domestic and foreign research situation of uninhabited islands protection indetailed. In addition, this paper also illustrates the research methods and innovations that areused to complete this paper. The second part introduces several basic knowledge ofuninhabited island, including its legal conception, features and classification. On the basis, thearticle emphasis on the uninhabited island’s legal attributes. Third, through explaining thehistorical causes, this paper expounds the necessity of uninhabited islands protection. At thesame time, by combining the current protection situation of our country, raising severalproblems among legal protection process. For example, the laggardness of legislation, relaxedapproval procedure, defective legal regulation means and the insufficient consciousness ofpublic participation. Forth, according to the current domestic and foreign research situation,taking the United States, Japan and Korea as typical examples, analyzed and summarized theirsuccessful experience in law making and case application for our island protection. Finally,put forward feasible suggestions to perfect our country’s uninhabited island protection.
