On The Rights Conflicts Of The Expression Of Microblog

The freedom of expression is one of the most important social rights in social subject.With the rapid development of computer and communication technologies, especially theappearance of micro blog, the new spaces have been developed; meanwhile, new-styleright conflict have been raised. All these right conflicts incur many social problems andthey need to be attached more corresponding solutions. This article has a theoreticaldiscussion to solve these problems reasonably and effectively from the perspective of rightconflicts by analyzing basic characteristics of micro blog and freedom of expressioncombining with the problem arose in practice.The article is composed of four chapters: thefirst chapter mainly summarized human rights and freedom of expression. It includes thedefinitions and classifications of human rights and the summary of freedom right andrelated definition, etc. It also contains brief description of derogation theory with properintroduction and conclusion of freedom expression theory, along with theory preparation offurther discussion for freedom of expression of micro blog. The second chapter centered onphenomenon of right conflicts in period of micro blog expression practice. This chaptercomprised of definition of micro blog, history of development and its own feature. Generaland legal characteristic of micro blog expression also supported the observation of thephenomenon when practicing in micro blog expression. The third chapter focused ontheoretical discussion of right conflicts. This chapter covered the definition of rightconflicts, dispute of whether exists or not, and the methodology of solving right conflicts,stressing specific analysis of the conflicts definition along with the reason and harmbetween freely performed micro blog expression and other rights. The forth chapter madethe further study of the solution of right conflicts in free expression in micro blog,involving, particularly, the theory of limitation for free expression in micro blog, such asdifferent position of right limitation, different alternative principle and various tendencies,compared with the regulation measures among American, England, German, South Korea,and India who are the representative of using micro blog as their social networking service.And the countermeasures and legislative suggestions of our country in present stage.
