The Freedom Of Expression On Micro-blog And Its Restriction

As a new media to express freedom, microblog has played more and more important role in our daily life, which has also become a necessary tool for many of us to communicate and accept information. Microblog could make huge contribution to the promotion of democracy, expression of self-worth and the prosperity of the social culture. But during the resent years, with a peak popularity of microblog, there has been various situations where microblog conduct tort to civil rights, so it’s necessary to have a research on how to limit the free expression in microblog to a reasonable level to make best use of its positive function.This paper makes a deep study in the theory and the principle on the freedom of expression and its restriction, on the basis of the combination of the cases both domestic and abroad during the history of microblog and by means of comparative analysis and academic theory analysis.According to the research, microblog has its own values in the promotion of democracy and the governance by law, but the freedom is not boundaryless, it would threaten some public and civil rights without any limitations. Therefore, it’s necessary to impose reasonable restriction on microblog with the instruction of some basic principles and methods. Moreover, microblog faces legal and administrative methods problem in the real life, this paper make a reference to the successful experience in the two legal system and propose a reasonable restriction on the freedom of expression from the respect of law, administration, conception market an Internet morality in the last part of the paper.
