Study On The Land Use Right Of Inheritance Problems

Generally speaking, there are three kind of the land system in the world:the private land ownership as U.S.A and Japanese, private perpetuity of the land; the United Kingdom land system, the separation between land ownership and use right, with not all people obtaining land ownership by not all people paying rent payment; the national department paid use system of land as U.S.S.R. For the impact of ideology, P.R.C executed the third system in a very long period, imitating U.S.S.R. However, with the Reform and Open Policy deepening and the market economy system developing, gap appears between this system and social demand.Thus, P.R.C has been reforming the part in superstructure, which is inappropriate with economic basis, break the rigid system of land ownership step by step, don’t establish paid use system of land for all. Due to some vague understanding in theories and practice, the civil land system of P.R.C still can’t integrate the modern civil law system, which has great influence on the deepening of legal system construction and the promotion of market economy progress. Land, an important resource, plays a more and more important role in the development of the society. The reform of economic system reform deepening and market economy system developing, more and more attention is paid to the social problems caused by land. This paper will point out some problems in land use system through introducing current land use system of P.R.C, and put forward some legislative suggestions, in order to play a positive role in perfecting the land use system.
