With the intensification of the adverse impact of global climate change to the world, in recent years, the international community, the emissions of greenhouse gases given more and more attention. The greenhouse effect of global decisions of this need to take measures to reduce emissions cost points cooperation between the countries in the world. International Climate Framework Convention and the Kyoto Protocol to be supplemented and perfected by the number of the Conference of the States Parties to build a response to climate change, the international legal system of carbon emissions trading. EU country as a carbon emissions trading system, a systematic analysis of its carbon emissions trading system, to establish our own carbon emissions trading system to learn.The first chapter of the formation of the United Nations Framework Convention on Climate Change and the Kyoto Protocol, content, meaning elaborated in detail the development of the legal system and the international carbon emissions.Chapter Ⅱ of the existing EU carbon emissions trading system, carried out a detailed analysis and elaboration, summed up the mature experience can learn from the EU carbon emissions trading system. The third chapter of the current situation and existing problems of China’s carbon emissions trading system, and learn from mature experience of the European Union on the basis of recommendations to improve our carbon emissions system.
