The Research On The Intellectual Property Protect-Ion Of China’s Industiral Design

Intellectual property rights is the exclusive rights of human being on the creation in thefield of literature, art, science and technology and other intellectual achievements, which isprotected all over the world. The theme of The World Intellectual Property Day2011is“designing the future”, reflecting the importance of intellectual property in the developmentof industrial design. Industrial design is related to many of the intellectual property rights,including patent, copyright, trademark and trade secret right. In recent years, the protection ofthe intellectual property rights of industrial design has been widely concerned in China, buthow to protect the intellectual property rights of industrial design effectively is still difficultproblem.The overall status of China’s intellectual property of industrial design is favorable, butthere are still some problems, including counterfeit, plagiarizing, misappropriate. In general,the intellectual property right of industrial design is not highly protected, but there are alsorelatively perfect protection systems established in some of cities and regions like Shenzhen.Designers generally indicate that people in China are lack of protection awareness for theintellectual property, and there are some problems in the intellectual property laws.As a creative intelligence achievement, the Industrial design contains the owner’s endeavorand must be protected. The protection of the intellectual property of the industrial design is acomplicated problem, so we should research it from multiple angles. The paper is based onthe investigation of China’s intellectual property of industrial design and the successful caseof Shenzhen’s protection of intellectual property rights of industrial design, combining thebasic principle of intellectual property law, putting forward reference scheme for theestablishment of the protection system of China’s intellectual property rights of industrialdesign in an overall angle.
