Research On The Present Situation Of Legal Practice Protection Of Chinese "Sports Events Intellectual Property"

Intellectual property rights is an important part of the operation of sports events.At the time of the rapid development of sports events in our country,the protection of intellectual property rights is particularly important.However,there are still many problems to be solved in the protection of intellectual property rights of sports events in China,and the healthy development of sports events in our country has been seriously restricted.Recognize the status quo,combing the reasons,to explore countermeasures,to strengthen the protection of intellectual property rights of sports events in China,has a very important significance.This study from the basic concept of sports events,intellectual property rights,intellectual property rights of sports events,sports events and analysis of the object of intellectual property relationship,summarizes the current domestic "sports intellectual property infringement types,and from the three aspects of legislation,law enforcement and judicial system analysis of China's intellectual property rights" sports law practice protection status,in-depth analysis of China's sports events as "intellectual property rights" protection of legal practice problems and the reasons in the United States Olympic intellectual property protection as an example to analyze the foreign intellectual property protection sports legal practice experience,put forward on the basis of dealing with "intellectual property" of the first sports event right protection measures.This study can further enrich the sports events in China intellectual property rights protection system of theoretical research and sports intellectual property rights protection system establishment and improvement and provide a theoretical support and provide some reference for the reform of sports management department.Through the research found that sports events in China for the protection of intellectual property rights exist in relevant laws,the lack of violations occur high frequency,violations found not timely and standard for judging the law of tort cases and other problems,the theory research is insufficient and the national attention degree is not enough,the law enforcement main body is not clear,legal level low,and people and sports industry practitioners awareness of intellectual property protection is not strong,and is leading to the root causes of the problems.From the practice and experience of the Olympic and amateur sports act,strengthen sports events in China intellectual property protection to speed up the legislative process of China's "sports intellectual property rights",increase our country sports intellectual property law enforcement,and improve the system of judicial protection of China "sports intellectual property rights",in addition to strengthening the public and the enterprise of "sports intellectual property" law-abiding consciousness.
