Freedom of speech, one of the most widely recognized civil liberties, means the citizen Of one nationcan express his ideas and opinions free in his nation. With the development of theInternet, especially theemergence of the network information data sharing, network has become another area for free speech,which is now an important ways of freedom of speech. In terms of its function the network has a doublenature, it can be the representative of the public opinions and the refection of the masses’ thoughts, and cansupervise the government and its officials, which promotes the social development meanwhile it can be alanguage tool of violence for the minority, distributing speeches which go against the nation、society orpersonal interests, all of which violate interests of the state、the collective or the individual. The Internet isdifferent from other medias, for compared to other medias, conflicts of free speeches on the net appearmore prominent and sharp. The conflicts are mainly in two ways: one is the conflicts between freedom ofnetwork speech and civic rights; the others is the conflicts between freedom of network speech and publicadministration. As a kind of free speech, network speech has its distinctive characteristics: in terms of itsfunction, it can promote the society, and supervises the government and its officials. While this kind ofspeech is unlimited, because it should be subjected to specification and constraint of duty and responsibilityclauses of law. Starting from the basic spirit of freedom of speech, this thesis researches the freedom ofnetwork speech, and puts forward the limitation countermeasures and methods to the harm of this networkspeech, to ensure that the public make reasonable use of their rights of this speech, and to make a balancebetween the freedom of network speech and the national、social、and private rights.
