The people can make a thorough supervision onthe behavior of the ruling party and the government and the quality of the officials, butthe Internet to the government safeguards and restrictions of freedom of network speechis a hard problem. Our country facing an unprecedented situation herein: neither canreference the past, also can’t simply follow experience of other countries.Adopted by Sixth plenary meeting by the seventeenth central committee of theCCP about to deepen reform of the cultural system to promote socialist cultural greaterdevelopment and prosperity on major issues marking our party attaches a greatimportance to the construction of socialist culture. Online media as an important carrierof cultural transmission, its reform and innovation to need to make a serious research,appear very urgent and necessary. Books and papers study in detail from a legalperspective of protection and limitations of the freedom of network speech is less,mostly of them from the perspective of the news media. The market economy is theeconomy of the rule of law, from the point of view of the media industry, legislation tostrengthen the Internet to improve the Internet administrative supervision, improvecitizen access to the Internet and moral self-discipline, and the healthy development ofChina’s online media industry is very urgent.This paper analyzes the types and characteristics of online speech in China, andstatus quo of the current legal regulation, and point out the pros and cons of freedom ofnetwork speech protection and restrictions, such as detailed description of the news,online forums, online publishing, microblogging and instant speech and other major thetypes of online speech and its major regulations and policies. At the same time on thebasis of existing practice, the author also puts forward the feasible suggestions topromote the network of the rule of law and democracy, so that makes it full of vibrant,healthy and orderly. The first part analyzes the meaning, characteristics, value and drawbacks of freedom of network speech and gives an account of the basic questions.The second part is our government protection and restrictions on network speech, forexample on the regulation of the news, online forums, web publishing, microbloggingand other remarks. The third part points out the drawbacks of China’s protection andrestriction measures of freedom of speech. In part IV the author proposes theimprovement of China’s protection and limitation measures on freedom of networkspeech related to network legislation, administrative supervision, and network ethicsmeasures, such as reducing unnecessary intervention of the law of online speech,rational use of technical means to filter harmful information, strengthening the networkuser’s moral self-discipline, promoting tolerance and improving the administrativesupervision on online speech.I hope this paper can provide beneficial references on the reform and innovation ofinstitution and mechanism of China’s internet culture industry.
