On The Protection And Restriction Of Freedom Of Speech In Internet

Freedom of speech is one of the basic rights in constitution. This right is important forthe human beings for they need to express ideas. Thoughts of freedom of speech can be findin the primary assembly in Ancient Greece Athens, and in modern times, freedom of speech isone of the core of classical liberalism. In1789, it was written in “Declaration of the Rights ofMan and of the Citizen”.During the long process of historical development, freedom ofspeech become perfect with the efforts of generations. Now, it has its new characteristics withthe development of the internet. Essentially, there is no difference between the freedom ofspeech in the internet and in the realistic society, and they presents different characteristicsjust for the different carrier. With the support of the internet platform, freedom of speech canbe realized in the wider space. The Internet provides a better condition for the realization ofthe right to freedom of speech, but some negative effects will follow, therefore, it is anoteworthy problem to take the legal and administrative measures to supervise the internet,which can mitigate the negative effects of the internet to the freedom of speech and protectthe rights of the citizens.This paper discuss this problem from four aspects. First of all, This paper bring the topicwith the concept of freedom of speech, and analyses the essence and characteristics offreedom of speech, and then analyses the positive value and negative effects of the internet tofree dom of speech with a large number of cases in the internet. Finally, this paper providessome suggestions on how to perfect the supervision of internet through the analysis of thecurrent situation of internet supervision and the problems.The first part, posing of a problem.This paper analyses the value of freedom of speechfrom the theories, and put forward the concept of freedom of speech in internet, and thenanalyses the characteristics and connotation of it.The second part, this paper analyses the value of internet as a platform to freedom ofspeech from positive and negative aspects and this paper emphasizes on the influence offreedom of speech in the internet on the public interests and personal interests.The third part, this paper presents the measures of network supervision in legal and otheraspects of several countries in view of the negative effects of overemphasizing of freedom ofspeech. Then it analyses the current situation of network supervision and the problems inchina, and provide the conclusion that it is necessary to protect the right to freedom of speech. The fourth part. This part analyses how to perfect the supervision of internet to protectthe right to freedom of speech. First, it is necessary to make clear of the boundary of theprotection and restriction of the freedom of speech in internet. Based on this, we shouldstrengthen internet legislation and law enforcement, and perfect the relief program when theright to freedom of speech is infringed.At the same time, it is important to strengthen theindustry self-discipline.
