A Discussion On The Possibility Of Specific Law Of Rural Culture Landscape Heritage Conservation

Thousands of years of Chinese agriculture culture has bred long-standing Chinese civilization,agriculture also is the important component of our national economy until now. China covers a largeterritory, has many nationalities and landform types. With the development of times and the mutualexchange and fusion of nationalities, rich and colorful and unique rural cultural landscape has beengradually formed in the rural area. On the basis of classification of Convention Concerning theProtection of the World Cultural and Natural Heritage, rural cultural landscape belongs tocontinuing landscape. That means rural cultural landscape is dynamic and developmental landscapeheritage types. However, this precious heritage types give into the predicament of protection andinheritance.First of all, this article combes through the establishment and development of China’s culturallandscape heritage conservation system; Secondly, seven uniqueness of China’s cultural landscapeheritage are analyzed; Thirdly, for the conservation of rural culture landscape, this articleinvestigates and analyzes the settlements, buildings, farmland and traditional cultures of seventraditional village in Zhejiang Province, summarizes the bad conditions historic villages facing;Forth, the relevant laws the rural cultural landscape heritage in our country following are analyzed,the regulations of these laws are discussed, and the problems are found out; Lastly, based on theabove analysis, this article puts forward the possibility and urgencies of making specific law of ruralculture landscape heritage conservation, proposes the fundamental principle and method.Rural cultural landscape heritage village contains all the information of its breeding andgrowth, show the process of reproduction generation after generation through the expression ofcultural landscape. But recently the clauses of statute which support the protection of traditionalrural culture landscape heritage appear sparsely in other law clauses of other departments, and thereis no special law about the protection of rural culture landscape heritage, the protection of ruralculture landscape has no law to depend on, and cannot get scientific and effective protection.Specific law of rural culture landscape heritage conservation provides standard and basis and legalprotection for the protection. Form the sustainable development point of view, we should buildsecific law of rural culture landscape heritage, mintain the harmonious development of thetraditional villages in order to protect the unique rural cultural landscape heritage in our countrybetter.
