Research On The Realization Way Of Thesocialist Concept Of Rule Of Law

In the recent18th national congress of the communist party of China, the rule oflaw is a word which aroused people’s attention again.Comrade Hu Jintao affirmed ourachievement in the past period of constructing socialism country by the rule of law,“grassroots democracy was developing constantly，the legal system of socialism withChinese characteristics has been formed, the construction of socialist country underthe rule of law has outstanding achievements”, but he remind us that the process ofconstructing socialist country under the rule of law is still faced with many problems.The concept of socialist by rule of law is the oretical foundation and valuesorientation we deepen the socialist rule of law,it is clear that the concept is of greatsignificance construction and improving the socialist society under the rule of law.Further in-depth study of socialist concept of rule of law, especially study how tocombine the socialist concept of rule of law with the reality of today’s society,andmake the socialist concept of rule by law really get implemented in a socialistharmonious society should be the most important research direction.This paper is divided into three parts:The first part, the connotation of the concept of socialist rule of law.Just byunderstanding the nature of things and the connotation can make us able to takeappropriate measures to the problem,research the realization of the socialist conceptof rule of law, must first clear the connotation of the concept of socialist rule of law.In this section,by analysing the gradually meaning of the concept at first,evolved tothe basis of the rule of law concept, the concept of socialist rule of law, andcomparised the concept of socialist rule of law and capitalism of the rule of law indetail, concluded that the fundamental difference and why the socialist concept of ruleof law is a scientific philosophy suitable for our present stage of nationalcondition.Secondly, introduce the concept of socialist rule of law theory origin,including China’s traditional culture and western ideas of rule of law, to providefurther insight into its connotation from different angles. Finally carried oninterpretating the content of the socialist concept of rule of law. Through this threeparts, the system cognitive connotation of the concept of socialist rule of law hasformed.The second part, the socialist concept of rule by law exist obstacles in practice.Itmainly include the conflict of Chinese traditional culture,western ideas and the concept of socialist rule of law under the rule of law;the problems exist in thepractice:socialist concept of rule by law in the legislative, judicial links,andadministrative by law;our party and the rule of law, the rule by law and managingstate affairs by ethics, the relationship between restriction by power and the rule oflaw process is not clear and legal awareness of citizens in our country moderneducation and the guide mechanism of the lack of influence in the practice of socialistconcept of rule by law and so on. Only by finding out the obstacles to the practice ofsocialist concept of rule of law, can we promote the establishment of legal ideology ofsocialism better and faster.The third part, the realization of the socialist concept of rule by law. Thissection put forward relevant suggestions to the obstacles of socialist rule of law existsin practice make the concept of socialist rule of law can realize as soon as possible.Firstly, swagger leave short, the correct analysis and use traditional culture andwestern legal thoughts; second, strengthen the construction of legislation, judicial andadministrative law links; third, properly handle the party and the rule of law, the ruleof law and managing state affairs by ethics, the relationship between power restrictionand the rule of law; fourth, strengthen publicity and education,establish citizens’modern legal consciousness.We must begin from these aspects,and solve the socialistconcept of rule by law, finally promote the implementation of concept socialist rule oflaw and construct socialist rule of law society.
