On "People-oriented" Idea And Improvement Of Chinese Prison Management System

As the penaltyexecutive organ of a country, the prison has the functions of maintaining socialstability, social justice and social security, which is related to the development of thesociety and the progress of civilization. The prison plays an important role in thestability of social security. Therefore the managers of prison must emancipate themind, renew ideas, advance with the times, master and comprehend exactly itsspiritual substance and connotations of legal principles, and promote the conceptinnovation of prison management in implementing the criminal policy of combiningpunishment with leniency. Especially, the harmonious society is constructingnowadays; changing the traditional idea of prison management and implementing thepeople-orientated scientific outlook on development based on the implement of thefundamental strategy of “rule by law” are very significant for the development ofprison, the improvement of management level and quality of prison and can preventand strike crimes. Under new circumstances how to make the reform work of prisonattain strong social effects is the ultimate goal for the existing and developing ofprison. The author holds that sticking to “people-oriented”, respecting people,understanding people, caring people and helping people, and giving the function ofgetting at the root of the reform of prison management full play should become thecore of prison work. Only by doing a well job in the management and reform ofprisoners can realize the function of prison of reforming and managing prisoners andgive a full play of the function. With the people-oriented idea, the management workof prison should center on the prisoners, highlight the all-round development ofhuman being, and put emphasis on the purpose and idea of “reforming criminal”,promote the education and reform of prisoners to work smoothly and steadily by rightmanagement ideas and scientific education and reform methods, in order to optimize the prison execution and reform quality. Today, crime problems have become verydifficult in the world. In order to develop harmoniously with the society, performprison’s function well, and realize prison’s social value, the reform and innovation ofprison must be intensified. Promote the fundamental change of the outlook on life,values and moral outlook of prisoners by realizing the function of getting at the rootof prisoners through good prison management; improve the personality of prisoners,correct their mistakes and wrong thought and make them repent and become goodand make the human nature recover by exploring the rule of development ofpsychology, acknowledge the actions of prisoners and tap the internal multiple ideasunder the actions; complete the process of re-socialization of prisoners and reformmost prisoners to become labors benefiting the society by “reshaping” and“reconstructing”, thus getting at the root. This is not only the core task of prison workbut also the fundamental requirement of building harmonious society for prison work.Besides, the fundamental rights protection of prisoners is the basic requirement andan important pillar of the “people-oriented” idea in prison management, which is ofgreat importance in law enforcement. The rights protection of prisoners not onlyrefers to the respect and understanding of prisoners’ human dignity, but also meansthe basic requirement and primary responsibility of prison police. The prison policeshould stick to “people-oriented” idea, respect prisoners, understand them, care themand change and reform them. On the protection of rights of prisoners there areexplicit laws and regulations ensuring prisoners to realize their basic rights. Althoughthey violate the law and their actions have a bad influence on the security andstability of the society, they are still Chinese citizens, and their legitimate right maybe violated. We should take an attitude to not opposing them but saving them, and weshould not maltreat them but reform them. We should treat them fairly and justly.Therefore the fundamental rights protection of prisoners is special and significant,which is also the conformation and respect of their human rights. Based on therespect and understanding of the human rights and basic rights of prisoners, scientificdevelopment can be realized and the “people-oriented” idea of prison managementcan be implemented stably. Under the new circumstances of social development andnew requests of the scientific outlook on development and tasks of promoting social harmony, the scientific outlook on development and people-oriented idea must beinsisted in prison management work and progress and development must be promotedby an approach of development, innovation ideas, and solid and simple style of work,and by providing powerful guarantee to the development of prison with high qualityand upright prison police, mobilizing the enthusiasm and subjective initiative ofprison police and ensuring the smooth running of prison management work. Theauthor analyzes the challenges faced by educational idea, method and pattern of themanagement of prisoners under new circumstances, centering on the key point of“people-orientation” and tries to solve the problems hindering the development ofprison, in order to make the development of prison consistent with the building ofharmonious society.
