Study On The Conflict Caused By The Urban Management Law Enforcement And Its Countermeasure

Law enforcement of urban management appeared in1984in an embryonic formand was established in1997. The law enforcement has made a great contribution to thedevelopment of economic and social, to the maintenance of social stability and to theguarantee of smooth transition of society since last29years. But the domain of lawenforcement has been being expanded. The authority of urban management has beenbeing outspread. The rigor of law enforcement has been being enhanced. urbanmanagement brings a lot of conflict and makes the urban management enforcement atthe forefront of public opinion.Many different levels and different kinds of conflicts have generated in thedevelopment of urban management. And many “innovation” illegal law enforcementmethods appeared. The typical ways are violent law enforcement, fishing lawenforcement, guerrilla law enforcement and corrupt law enforcement. There is noborder enforcement endogenous expansion mechanism in law enforcement includingself-endogenous expansion mechanism of unconstrained power, the endogenousexpansion mechanism of maximization of profit drove by the pursuit of interests, theunlimited expansion mechanism without power tension force resistance andpsychological twist mechanism without external confinement. In order to solve theconflict of law enforcement, it must find the original reason causing the conflict andfollow the logical conception.According to the above logical conception, the significance and the background inthe topic were discussed in the first chapter of this research. Theoretical basis of ourstudies including social conflict theory, aesthetic order, public service, governmentmechanism and so on were explained in the second chapter. The generation of urbanmanagement was sorted out in the third chapter, accompanying with the illegal orimproper enforcement phenomena. There was an intensive study of the reasons causingthe conflict of urban management in the fourth chapter including: lack of legal basis,system reason, law enforcement team. The summary was suggested in the sixth chapter.And the disadvantages of this study and the direction of the further study were bothpointed out in this chapter.Urban management law enforcement has made an outstanding contribution to China in its transition period. But it also has generated many problems at the same time.Analysis of the reasons causing the conflict of urban management law enforcement andthe investigation of the corresponding countermeasure present practical significance intheory and practice for the health and sustainable development of urban managementlaw enforcement, the construction of harmonious society put forward by the PartyCentral Committee and the suggestions provided on the theoretical method andapproach.
