China has a feudal autocratic history of more than two thousand years, whichpossesses a complete theoretical system and ruling basis. Confucian ethics as thetheoretical basis of "rule of virtue" has been the mainstream ideology of feudalsociety in China. The moral rights which lead to China itself against autocraticdemocracy thought is in a subordinate position, which is known as the "immorality"title is being oppressed. Until the outbreak of the Opium War in1840, the feudalsystem of theory of China can not solve all the problems encountered. Western ideasof right along with the external invasion impact the feudal rule. With the disillusion ofthe Celestial Empire,Chinese thought circle woke up, they began to get rid of thedelima,relying on the Chinese local thought to absorb western political thought. Chinaalso entered to the modern times, which is an era of great change.The social reform of China firstly started from the change of idea, the mostobvious feature is the awakening and transfer of rights. After the defeat of Opium War,China became a semi-colonial and semi-feudal country from an independent country,national sovereignty was segmented. In the process of accepting western idea of rights,consciousness of individual "rights" came into the realm of thought, personal "rights"is reasonable argument with every step of the development of ideas in China, this iscaused by the special representative of individual "right" word, that is "the civilrights".With the progress of the times, the difference of demonstrative subject, themeaning of "civil rights" has different explanation.During the stage when the idea of"civil rights" was formed, which was not put forward clearly, it was just reflected inwestern idea of rights, but with the growing strength of the bourgeoisie, thebourgeoisie made their own demands for their own rights, the early bourgeoisreformists were not content with "civil rights" as the means of auxiliary power tosolve this problem, on the basis of the landlord reformists, they demanded more rights in the reform of the Council, and the co-existence of the emperor authority, and theco-existence of both.During the period of the Reform Movement of1898, the matureperiod of the bourgeois meliorate, who made a further development based on the"civil rights" thought, individual "right" has been widely accepted and became a newkind of universal value, the "civil rights"was above the divine, which implemented thereal meaning of the constitutional monarchy. However, the feudal forces did notconcile to their own demise, relying on the feudal system itself to change in Chinacould not be realized, under the experiences and lessons of meliorate’ failure, thematurity of bourgeois revolutionist’ theory marked the formation of Chinesebourgeois ideology and it was also the basis of the complete destruction of Chinesefeudal rule and the construction of the bourgeoisie Republic of China. At this time theconception possessed by civil rights showed its inseperable and nontransferablefeatures.
