Administrative Jurisdiction Conflict Resolution Legalization Explored

In the contemporary administrative management system, the issue of administrative power limits conflict arouses wide attention in overseas and domestic. As an inevitable key point of constructing the legal system government, power limits conflict between the administrative authorities is not only a problem within the administrative system, but also a legal issue. Guided by the requirements of "building a sound mechanism of coordination and collaboration between government departments" proposed on the17th CPC National Congress, based on the analysis of coordination of administrative conflict, this article aims at summarizing the ways of administrative coordination on the basis of super-ministries of China from the angle of building the legal system government with the reference of the experience of administrative power limits conflict resolution from foreign countries or other relevant areas to apply to the practice of legal system and mechanism and so on in order to create the new practical system in accordance with China’s current situation to solve the power limits conflict.This paper is divided into five parts. In the first part, starting from the overview of administrative power limits, the article gives the concept of administrative power limits conflict and analyzes the harmfulness of wrongly performance to generalize the characteristics of the administrative power limits conflict and the importance of resolving the conflict. In the second part, the article analyzes the causes of administrative power limits conflict from the aspect of system and law, and elucidate the explorations and practices from government. In the third part, the article presents the dilemma for practicing the resolution of administrative power limits conflict. In the fourth part, the article introduces the practical case from the developed countries and other areas for reference. Finally, in the fifth part, the article gives the outlook of the legal road of solving the administrative power limits conflict of China.
