Research Xishuangbanna Ecological Security Legal System

With the aggravation of environmental pollution and ecological destruction, ecological security as a new concept of national security has attached great attention in the international society. Ecological and environmental security refers to the ecological environment is not or less affected by the damage and threat status, which is the least ecological and environmental status required for maintaining the survival and development of mankind. Nowadays, the ecological security situation in our country is extremely poor. Serious problems exist in the respects of sustainable use of natural resources, ecological environment status, and the ecosystem stability and so on. In order to guarantee human health and living standard, sustainable development as well as ecological security, it is necessary to avoid adverse impacts due to ecological problems in social life and production, which promotes the national safety. Therefore, the ecological security law system should be established as soon as possible and the countermeasures should be constructed for ecological security.In the1940s, non-traditional security concept began to prevail internationally, the concept of which refers to the economic, social, environmental and other fields of security problems out of traditional security problems. With the aggravation of global environmental crisis, environmental security showed up more and more importance as kinds of the non-traditional security. In1991, the USA published "Report of the National Security Strategy" and took the environment as part of national interests for the first time. Then the European countries and Japan took the environmental and ecological problems as an important part of the national security strategies. With the development of industrial and agricultural production as well as the acceleration of urbanization, the growing environmental problems have also been put on the agenda in our country. Although China has initially established the related legal system, but problems still exist in the construction of the specific legal system and practice, including the concept of ecological security legislation lagged behind, unilaterally emphasis on the administrative management mode while neglect the social public participation, simply negative control while ignore the construction of ecological safety, incomplete of ecological security legislation system and lack of unified coordination, ecological security only for the purpose of legislation and lack of important legal system and support. In order to strengthen ecological protection, build sound legal system of ecological security, guarantee ecological security of our country using lots of methods, promote harmonious development between human and ecological environment, I think not only the overall construction of theoretical system is necessary, but also different countermeasures is needed for different ecological characteristics in different areas. Research on the ecological characteristics and the legal protection status of areas with complicated ecological problems, and put forward countermeasures and suggestions accordingly are important preparatory work needed to formulate ecological protection law in the future.Xishuangbanna prefecture has precious tropical rainforest climate, with abundant species and resources, as well as a plurality of Minority Areas and variety of different ethnic customs and religion. It is an ideal place for researching the law and system of ecological security. In this paper, the ecological environment of Xishuangbanna prefecture and the laws and regulations, policies as well as the custom law affecting local ecological protection were treated as the research object. On the basis of briefly introducing the definition and characteristics of ecological security law, the ecological protection law and the problems of Xishuangbanna prefecture were analyzed systematically. Furthermore, suggestions were promoted as how to improve the ecological protection legal system of Xishuangbanna prefecture and make ecological safety law in the future.
