In the South China Sea, Vietnam has the longest maritime borders line in theChinese neighboring countries (from the Beibu Gulf to the southernmost tip of theSouth China Sea). Currently, there are serious differences between Vietnam and Chinain the South China Sea sovereignty stance. Vietnam is China’s biggest rival in theSouth China Sea dispute.In fact, after the establishment of diplomatic ties between the two countries sincethe1950s, the Vietnamese government has a long-term recognition of China’sgovernment sovereignty over the Paracel Islands and Spratly Islands. Research thehistory, we can confirm that the Vietnamese government has the recognition of theChinese government-owned the sovereignty of the Parcel islands and Spratly Islands,its position was voluntary, coherent and consistent since Vietnam gettingindependence. Only after the mid-1970s, the Vietnamese government was in violationof the basic principles of the Charter of the United Nations and international lawcontinuous because of his occupation of a large number of islands and reefs of theSpratly Islands, so that the dispute has been getting enlargement, complex, long-termand internationalization between the two countries. As a result, the two countriesbroke out Red Reef Naval Battle in March1988. The dispute between China andVietnam is that the Vietnamese government does not respect the objective historicalfacts and serious violate of the basic principles of international law. Vietnam is theinitiator of the South China Sea dispute between China and Vietnam. This papermainly consists of the following:The first is to introduce the sovereignty dispute of China and Vietnam on theParcels and the Spratly Islands. Include: The introduction of the profile of the Parcelsand the Spratly Islands; The history and current status of the Sino-Vietnamese Parcelsand Spratly Islands sovereignty dispute. Secondly: The analysis of this issue from twoperspectives of history and jurisprudence. Including: The Parcels and Spratly Islandssovereignty long-term recognition of the basic facts of the Vietnamese government;From the perspective of "estoppels" and classic international judicial case to refute thefallacy of the Vietnamese Government, and to demonstrate Chinese sovereignty overthe Parcels and Spratly Islands no doubt. Finally, I will briefly make policyrecommendations for both sides on this territorial dispute in the future to solve thisterritorial dispute, in order to provide some thoughts for the future development ofSino-Vietnamese relations.
