| In the modem disciplinary mechanism, an explanation of "people" is often covered up in the system, procedures and rules. Discipline only means sexual significance.To highlight the subject status of people and implement disciplinary virtue, this paper argues that it should be analyzed from the Angle of virtue ethics,back to the origin of punishment——morality, at the same time, Confucian punishment mechanism provides a good reference for this purpose. Actually, I hope to provide an interpretation road for Confucian punishment mechanism under the perspective of virtue ethics,and provide a value guidance for the modern punishment mechanism.In this paper, I studied Confucian punishment mechanism under the perspective of virtue ethics.Firstly, I state the cause of Confucian discipline and the realistic roots of that under the perspective of the theory of human nature,and I think that punishment appears in the forms of punishing evil.Secondly,I analyze the virtue of Confucian discipline on the perspective of the "synchronic":which generates in the disciplinary practice, generates in the independent pursuit of excellence, and Confucian discipline endogenous moral standards.Thirdly,I analyze the practice of Confucian punishment mechanism in the diachronic perspective, and deep into Confucian’s world from text, case.The fourth chapter, I request the decider from two aspects of sincerity and will:to the best of their ability to find out and expend sympathy rather than be glad.The last, I state that punishment should be centered on the parties to highlight the subjectivity of the parties.Through the analysis of the above several parts, I not only provide an interpretation road for the Confucian punishment mechanism, reducing the generation and practical style of Confucian discipline, but point out its limitations and significance.Understanding can provide the basis for the modern society, the traditional reflection on the traditional direction can provide reference for modern societv. |
