Internet is a double-edged sword. On one hand, it has changed people’s lifetremendously. It makes communication more conveniently. Life becomes easier. Onthe other hand, it has brought many problems. It becomes the cradle of many newcrimes about internet. The Internet Theft is one of the wildest crimes on internet.The Internet Theft is the most common crime in the network society. It is thecrime that stealing information, digital money or other virtual property by usingcomputer and internet. It holds the features of disguise and low cost, so that it happensfrequently. And it always involves a large sum of money. It is a severe crime.The Internet Theft is a crime about stealing by using computer and internet. So itholds the features of theft and internet. It is a new form of crime. Therefore, newproblems appear while applying Criminal Law, e.g. completion of theft, definition ofvirtual property, definition of internet theft and other crimes. These problems have notbeen solved yet, so during the trial, stealing through internet are often sentenced todifferent crimes. It’s bad for fighting against crimes, maintaining the authority of theLaw, and protecting people’s property.In China, there is not a clear definition of Internet Theftnow. There are onlyseveral legal provisions about stealing through internet. For these reasons, this articlewill illustrate the definition and the constitution of Internet Theft, discuss theproblems mentioned above, and then give solutions of solving these problems. At last,this article will give some suggestions to improving Criminal Law to deal with similarproblems for the future, hoping to make some contribution to understanding andimproving the Internet Theft.
