Supervision Mechanism Of China 's Procuratorial Organization Itself Rights

The main object of the self-investigation power is the investigation of the duty crime. The execution of the self-investigation power is directly related to the anti-corruption issue, and is especially easy to cause the extensive concern of the society and people. The abuse of the self-investigation power will not only violate the legal rights of the citizens and cause severe social influence, but also cannot crack down on duty crimes, and affect the exercise of the functions and realization of the supervisory functions of the procuratorial organs. The article uses the basic overview of the self-investigation power in our country as a starting point, and carries on systematic analysis and elaboration through five parts on the current situation of the supervisory and restrictive mechanism concerning self-investigation power and existing problems, and also put forward some corresponding suggestions.Part one, in this part the author briefly discusses the concept and characteristics of the self-investigation power under the procuratorial organs, and also elaborates the necessity of the supervision and restriction on the self-investigation power.Part two, in this part the author elaborates the current situation of the external and internal supervision of the supervisory and restrictive mechanism concerning self-investigation power under the procuratorial organs itself in our country through both sides of legal norm and main performance.Part three, in this part the author briefly discusses and analyses the supervisory and restrictive mechanism concerning overseas duty crimes through viewpoints of both continental law system and Anglo-American law system.Part four, in this part the author gives some deeper study on the defects and deficiencies of the supervisory and restrictive mechanism concerning self-investigation power through the viewpoints of imperfect relevant laws and regulations and poor performance of the laws.Part five, in this part the author gives some comments and suggestions on improvement of the supervisory and restrictive mechanism concerning self-investigation power from multi-angles.In a word, the comprehensive and rapid development of social undertakings in our country, the continuously upgrade of duty crime means and the people’s growing law consciousness all make it more and more difficult for the investigation of the duty crime, and procuratorial organs especially the self-investigation department faces more severe test. The exercise of the self-investigation power by the self-investigation department causes the concern of all circles of society. The supervisory and restrictive mechanism, which is currently in effect is no longer meets the needs of the developing conditions. The improvement of the supervisory and restrictive mechanism concerning self-investigation power under the procuratorial organs itself in our country is imminent.
