Procuratorial Room Construction Standardization Path

The establishment of basic level procuratorial offices is an innovation of China’s procuratorial system. Strengthen the construction of basic level procuratorial offices are the need to deepen structural reforms and to improve the socialist public prosecution system with Chinese characteristic. By strengthening construction of basic level procuratorial offices, the procuratorial organs could extend the range of legal supervision. It can provide even more choices for legal supervision, be helpful for proper exercise of prosecutorial power and perfecting the socialist public prosecution system with Chinese characteristic. In recent years, combined with reality the procuratorial organs are very strict about "the guide for furthering strengthen and standardize the procuratorial powers" issued by the Supreme People’s Procurator ate, actively explore more ways for extending the scopes of legal supervision and firmly push forward the construction of basic level procuratorial offices. Now this work has gained a good beginning. But in practice, the content, procedures, effectiveness and legal basis for basic level procuratorial offices to fulfill duties are not unified and standardized, and have always been controversial. Under the new situation, to promote normalization of the construction of basic level procuratorial offices, we should pay more attention to suit the people’s conveniences, protect fundamental rights and control the abuse powers, constructing standardized path from the functional positioning tasks, basic principles, form and carrier, operating mode, mechanism construction and other aspects.
