Research On The Intellectual Property Protection Under The TRIPS Agreement

International intellectual property laws tend to integration and demand a common standard—TRIPS Agreement. TRIPS Agreement is an important part of WTO legal system. China has built up IPR System, but it still has gaps with TRIPS Agreement. This thesis firstly overviews the brief theory of TRIPS Agreement, then elaborates the demands of member countries on following aspects:general obligation, civil procedures and remedies, administrative procedures and remedies, interim measures, border measures and criminal procedure; and summarizes the current situation of property rights in China and analysis the divide between our intellectual property policy and TRIPS Agreement finally. Based on these, this thesis provides measures to improve the protection of IPR and hopes to solve the IPR protection problems in China.
