Civil Dispute And Administrative Dispute Settlement Mechanism Of The Cross

Since the1990s, so many cases in the civil justice of people’s court in China are the ones which result from the crossing of civil disputes and administrative disputes rather than simple civil cases. Let us take the estate disputes in Jiaozuo of Henan province as typical case, which also draws the attention of people on the civil-administrative problem. The problems result from the interaction of civil disputes and administrative disputes have been appearing and extending as the administrative power, which such cases now are in a tendency of rising. It brings new problems in judicial work, which is also the important challenge in our judicial work. This thesis aims to discuss the solving mechanism of the civil-administrative problem from three main sections. This thesis will analyze the social environment background and judicial environment deeply and detailedly, combine with the similar solving mechanism to the problems in abroad, make a comprehensive analysis and reference, construct a solving mechanism to the civil-administrative problem which is suitable to the national conditions combining with the actual and objective situations in China. Among the mechanism, it includes the building idea, principle and specific procedures.
