| Since1996, China Merchants Bank took the lead in the opening of " card " payment online financial services, Chinese Internet banks got rapid development both in quantity and the type of business during last10years, and had an enormous influence on traditional bank. At the same time, there were a large number of problem on the supervision of Internet banking, how to deal with the on-line bank supervision legal system problem and protect the Internet bank safety is the most important thing.But at present, the legal system of our country online banking supervision is not perfect, this is certainly will affect the health, safety development of Internet banking. In China, Internet banking has developed very rapidly in recent years, some problems about Internet banking on legal issues is studied more, but for the Internet banking supervision legal system are few, the research monograph is only one, specialized thesis only a few, PhD, MA thesis, only about a dozen. Apparently, the research on Chinese Internet banking supervision legal system is weak. Overseas network bank developed relatively mature, Internet banking supervision legal system is relatively perfect. The purpose of this study is to learn from Chinese traditional banks and overseas network banks supervision legal system theoretical research and practical achievement, combining with current situation of the development of online banking in China and the specific features, provide some ideas for our online banking supervision law system improvement and perfect.This paper consists of four chapters:The first chapter:overview of the legal system supervise on network of bank. First, summarized our country and overseas country financial institutions with respect to the network banks in various representations, makes clear that our country has no pure internet bank, just the bank on the net. In this paper, using concept, involving foreign related issues will use the network bank; usually involves similar problems in China will use the bank on the net, according to the principle which concept is true of the name, next analyzed the relationships between different concepts about network bank; then summarizes the common characteristics of network bank; and then expound the meaning of supervise internet bank legal system; at last is the significance of supervise internet bank legal system.The second chapter:Internet banking supervision legislation and implementation. First elaborated the characteristic of Chinese network banking; secondly, summarizes the current situation of Chinese Internet banking legislation; the last of some problems of Chinese Internet banking supervision legal system.The third chapter:overseas countries experience of supervise on Internet banking legal system. Describe the current situation of other countries network banking legal system, mainly introduced the United States and the European Union network banking supervision legal system; summarizes other countries experience of network banking supervision.The fourth chapter:perfecting Chinese legal system of supervision on Internet banking. On the basis of above analysis and summing up, put forward some advises to Chinese internet banking supervision legal system mainly from four aspects.In this paper, using historical analysis, comparative analysis, logic analysis and other research methods, on the base of use other countries network banking supervision legal system valuable experience for reference, put forward some suggestions to improve Chinese Internet banking supervision legislation system, supervision system, supervision target and supervision contents, which has certain practical significance. At the same time, Chinese online banking supervision legal system of banking supervision legal system as a part of the legal system is an important part of the finance in China. Therefore, this thesis has both theoretical significance, but also has practical significance. |
