Since the beginning of the21st century, the development and application of information technology by leaps and bounds have a profound impact on China’s economic and social development. At present, China is in the initial stage of development of the information society, and the science and technology is making our lives more convenient and diverse, and at the same time, the negative impact brought about by the development of science and technology also makes us miserable. In recent years, China’s personal information’s security situation is not optimistic, personal-information-spilled events appeared frequently, arising spam messages, spam emails, harassing phone calls to make our life standed it, and even the use of the illegally obtained personal information for criminal activities. The emergence of this situation is a direct relationship with our imperfect legal system of protection of personal information. Starting from defining the concept of the personal information, in-depth analysis of the legal basis for the protection of personal information and the status of China’s personal information protection and problems, the investigation on comparative law, and then as the basis for the design of the system of our Personal Information Protection Act.The paper is organized as follows:The first chapter defines the concept of personal information so as to clarify the scope of the study and the basis of the full text.The second chapter focuses on the value of the protection of personal information based on practical needs and theoretical premise, and demonstrates that the protection of personal information is the inevitable result of development of the theory of personality rights, in line with the development trend of the theory of property rights issues.Chapter Ⅲ analysises of the status of our personal information protection legislation and self-regulatory conservation, and puts forward the main problems of China’s protection mechanisms.Chapter Ⅳ by a comparative study of the relevant international organizations, Germany, the United States and Taiwan and Hong Kong on this legislation, depthly analysis of the revelation of personal information protection. Chapter V highlights the urgency and the need for information, related to the main rights and obligations as well as the civil protection of personal information.
