Research On The Protection Of Personal Information From The Perspective Of Constitution

With the advent of the information age,both the information technology is developed and the government giant database developed earlier Western countries or China,the issue of personal information protection can always cause people's concerns.This concern not only from the media exposure of the social and commercial subjects of citizens of personal information violations,but also from the public authority of the personal information on the potential threats and real violations.Based on this concern,this paper attempts to explore the path of personal information under the protection of the path:The first part mainly introduces and compares the definition of personal information in the legislative documents of different countries and regions,summarizes the connotation and characteristics of personal information,puts forward the right of personal information and explores the constitutional basis of personal information right-"human dignity ",And personal information related to the basic issues were discussed.The second part aims to study the current real needs of personal information protection in China,explores the legislative framework of personal information protection in China and the legal dilemma.The third part mainly introduces the experience of personal information protection.This paper explores the united legislative model based on the information self-determination right in Germany and the decentralized legislative model based on the information privacy right of the United States,and sums up the experience of the two.The fourth part puts forward the path choice of personal information protection in China under the constitutional perspective.First of all,should establish the personal information protection of the constitutional basis,followed by the development of a unified "personal information protection law",once again set up a special personal information protection agencies,and finally,through the improvement of personal information protection of the unconstitutional review relief to build our personal information Protection system.
