The Criminal Policy Perspective Execution System For Prison Studies

The establishment of the criminal policy of combining punishment withleniency, has great influence on our country’s criminal legislation and criminal justice.The lenient and strict criminal policy has improved the system of punishing andpreventing crime countermeasures, to establish a scientific, rational, humaneexecution idea and mode, and the execution of punishment is an important way torealize the purpose of criminal policy, the implementation effect and measure ofcriminal policy science, correctness, validity. Tempering criminal policy to the prisonexecution penalty play a very important role, but the traditional prison executionconcept, the current penalty execution problems, poor prison management all restrictthe criminal policy of combining punishment with leniency in the prison executionprocess of application. Then based on the analysis of the problems above, to explorenew measures from the perspective of criminal policy leniency in our country underthe prison system reform.This paper is divided into four parts. The thirdpart is the analysis of our current prison system in the implementation of the criminalpolicy of combining punishment with leniency dilemma, mainly commutation, parole,the temporary execution outside prison, and separate responsibilities, progressivetreatment on "against the wide" and "strict". The fourth part is a clear trend in prisonconditions in China, and puts forward some theoretical suggestions on China’s reformof the prison system.
