The Prison Execution Of Social Research

The contemporary prison system isolates criminals from the normal society and aims at building a prison society in which criminals are punished and rehabilitated. However, rational building has its limitations. This paper based on criticism to close prison punishment system, researches on the models of socialization of execution of sentence. Except the introduction, the paper is divided into five chapters.In the first chapter, the author points out that the traditional close system of execution of sentence fails in real rehabilitation although it aims at rehabilitation in macroscopic policy and tries to apply rehabilitation system to contain it. This close system of execution of sentence reveals several problems, which in turn causes dilemma in its current situation.In the second chapter the author firstly brings forward the definition of socialization of execution of sentence and points out that the socialization of execution of sentence surpasses the traditional close system of execution of sentence. Then the author analyzes the characteristics of the socialization of the execution of sentence. Finally this paper clarifies the contemporary situation of socialization of execution of sentence and points out that it has become popular in the international scope.In the third chapter, the author puts emphasis on the legal value of socialization of execution of sentence. The choice of the model of prison punishment should base on the reasonable and rational value system. The socialization of execution of sentence reveals the value system of humanity, democracy and efficiency.The fourth chapter gives a through analysis on the necessary conditions for socialization of execution of sentence. The first condition is social condition. The realization of the socialization of execution of sentence mainly depends on the conditions in all aspects of society. The focus is to build a proper air and environment for community-based rehabilitation. The condition of prison itself should be considered as well. Finally, the socialization of execution of sentence is attracting more and more attention of society, but that should not be excessive.The criminal who is executed socialized should have certain conditions.The fifth chapter suggests the model of the socialization of execution of sentence. The author would like to regard the out-prison-system as a gradual process. From the moment when criminals enter the prison to the finish of punishment, the rehabilitation and return to the society should be our utmost purpose. Generally speaking, criminals should be divided into different categories and executed in different prison systems. Furthermore, the prison environment should not be strictly separated from the society and we can try to make the prison environment similar to that of the real society. Also we can change the restraints on the release on probation and improve the rate of its application. Finally, we can create new education methods and build progressive treatment policy so that the tenet of the prison system can be realized.
