With the rapid development of economic globalization, our life style is changing andthe human living environment has been destroyed day by day. Today’s society, which isno longer the traditional society, has been transformed into a high risk society. In such anunstable and risky environment, the public health field is also facing the huge challenge,and public health emergencies occur frequently, for us, which also became a "normal"phenomenon. In2003,"SARS" which havocked in32countries and regions, was a typicalpublic health emergency. After the outbreak, our government and people faced theepidemic SARS confoundedly, the society quickly set off a wave of panic buying, and ourcountry immediately entered into a disorderly life. These were fully exposed in the field ofpublic health response mechanisms existed emergency legal system imperfectly,monitoring and warning work not reaching the designated position, information channelnot expedite, emergency rescue ability weak and many other issues. It more highlights theestablishment and improvement of China’s response to public health emergencies of legalsafeguard mechanisms, which is important and urgent to ensure the people’s lives andhealth, to construct a suitable living environment and to promote the development ofsocialist economy.The paper expatiated the various subjects of rights and obligations andresponsibilities in the emergent public health events, based on the related basic theory,combined with our country public health emergency response status and the existingproblems, by learning from other countries’ successful practices, and put forward theimagination of establishment and perfection of public health emergency responsemechanism in China. The full text was divided into three parts:The first chapter mainly discussed the topic of "public health emergencies" as thebasic overview. First of all, through the analysis of the serious harm of the public healthemergencies, the basic concept and characteristics of the public health emergencies was expressed, and the public health emergency response principles was summed up; then, thepart focused on analysis of the rights and obligations of the administrative organs andother interested parties in the emergent public health events.The second chapter firstly analyzed the data of the frequent infectious diseases, foodpoisoning and occupation poisoning and other types of public health events in China atpresent, which expatiated the various issues of the public health emergency responsesystem.The third chapter expatiated the reform of our public health emergency responsemechanism. The author firstly through the analysis of the successful practices of thedealing with the public health emergencies in the United States, France, Canada and Japanand other countries, and based on these practices and our country’s actual situations, fromthe legal construction, government crisis management, public health and medical building,the judicial system of guarantee and social forces and other aspects put forward severalcountermeasures in the light of our country public health emergency responsemechanisms.
