Democracy is a proper meaning of political life for socialist country.Its manifestation in the process of legislation is to let the public take part in it and come up with their anticipation and advice of laws,so as to have substantial influence onthe legislative activities of the institutions.Now China is endeavoring to broaden the channels that the public can participate in democracy,and the way of soliciting advice for the draft laws through Internet is exerting its endless potential.The general public is also showing great enthusiasm to this kind of participation.Currently,although the legislative bodies in our country widely use the online opinion soliciting system in the legislative practice,there is no unanimously made written terms and systems for regulation,restrict,ion and supervision,resulting in problems in practice such as strong random and optional nature,legislative institutions’ not timely feedback to public opinions,as well as not overt enough information.Therefore,this paper tries to be based on the experience and lessons from the past practice,and comes up with preliminary framework and design scheme for the systematic construction way of democratic legislative procedure.There are5parts in this essay:The first part is to elaborate the related issues of China’s network political participation.It defines the network political participation first,and describes the current developing situation in our country and its characters.What’s more,it analyzes itspromoting significance for democratic politics’ progress.Under this general background,it puts forward the central issue that will be expounded in this paper:networkpolitical participation in legislation,which forms are draft laws’ online opinion soliciting.The second part is to expound the circumstances of the draft laws’ online opinion soliciting from the public during the legislative process in China.It introducesthe concept and function of the ways for this legislative democracy,and then analyzes the situation of its beginning and implementing.What’s more it makes simple depiction of the current situation.The third part selects3typical daft laws that are issued and put into effect through open online opinion soliciting.They are "Law of labour contract(draft)","Lawof social insurance(draft)" and "Law of individual income tax(draft)".They are discussed and analyzed one by one,and the paper has introduced the data statistics oftheir solicited opinions and the situation of the detailed opinions.The fourth part collects the cases of the three typical drafts analyzed in the third part and compares the differences and similarities of them.And then it concludes and summarizes the differences and similarities amid the process of soliciting opinions,in order to offer reference data in the following passages for the institutionalized foundation of the draft laws’ online opinion soliciting.In the fifth part,it firstly shows the offoreign legislative situation and that among them is worth using for our reference..And then according to the experience and lessons got from the chapters above,the author tries to come up with systematic structural construction for the democratic legislative form of draft laws’ online opinion soliciting.
