Self-tour is that tourists are according with their wishes, their choice touristdestinations, routes of their own design, arranging a trip with all the affairs of aself-organized way to travel. Self-tour is freer, more convenient and individual comparedwith the tour whose agency has been arranged. This is the tour that the young like to travel,that is in line with their uninhibited personality. So the locations they choose are notincluded as tourist areas with advancers, where farer people go. So self-tour is a full riskway to travel. In the process of self-tour, physical and property damage have oftenoccurred, who pay the bill for the damages became a controversial topic. China’s relevantlaws have no clearly defined which resulting in differing court judgments on similar casesgreatly. In a long time, will inevitably lead to social problems, I hope this article have thebenefit to legal theory and judicial practice. Therefore, this paper is mainly from thefollowing aspects dealt with related issues.The first chapter of the issues is that self-tour it involves definition and legal natureof self-tour, the rights and obligations of organizers and participants.The second chapter discusses that in which Tort Liability Principle organizers bear,and the standard of liability is the violation of the safety duty of care to bear.The third chapter discusses that in which basis organizers have to bear the liability forbreach of contract, and how to identify.The forth chapter discusses that according to the status of China self–tour, I proposea number of legislative proposals, and hope that we can contribute to the development ofself-tour.
