Study On Coping With Emergencies Involving Prosecution

Nowadays, with the transition of China’s economy synchronizing with socialtransformation, interest relations and interests pattern adjusting deeply, the apparent andpotential social risk is on the increase. The various social problems caused by people’sinternal contradiction are prominent, and the expression of social contradictory conflictbecomes increasingly direct and intense that some have evolved into emergencies. As akind of classification of occupation in different field, the procuratorial emergency is theextend of emergency to procuratorial organ. Since the contradiction caused by injustice,dishonest and lax enforcement has upgraded to emergency, sometimes its focus also turnsthe direction to the procuratorial organ that has been given legal supervisory functions.The suddenness and extremeness of the procuratorial emergency is a kind of challenge forthe procuratorial organ to dissolve the contradictory and maintain stability. How toproperly deal with procuratorial emergency has become the major task of procuratorialorgan and each prosecutor that are facing and to be solved urgently.Therefore, under the procuratorial perspective, the focus of this paper is to exploreresponse principles、methods and main steps dealing with procuratorial emergency, tocultivate relevant ability and to put forward corresponding countermeasures from thetheoretical angle、procuratorial work and empirical study, etc.In this paper, the main content is divided into four parts altogether:The first part, from a theoretical angle, analyzed the concept, classification,characteristic and function of procuratorial emergency. In reference to the experts andscholars at home and abroad on the basis of the definition of public emergency, to defineprocuratorial emergency from the procuratorial angle and classify it from different angles.This part discussed the value of dealing with procuratorial emergency from the aspectslike the procuratorial work should serve overall situation, have affinity to the people andits function, etc.In the second part, the present situation and cause of procuratorial emergency in ourcountry are analyzed. On the analysis of the status quo, this part have listed7causes ofprocuratorial emergency in the practice of procuratorial work, as well as particularly highlighted two kinds of key case in high-risk areas, and have put forward a new concept"online procuratorial emergency" which is another kind of existent form of procuratorialemergency under the background of virtual world of cyberspace.The cause of the incident is very complicated, the author only analyzed in terms ofthe legal system and other three aspects.In the third part, the author has focus on discussing major method to deal withprocuratorial emergency, which spread out from basic principle, major link and noticeitem. When dealing with emergency, we should follow the occasions, but there are still theuniversal principle containing some certain procedure and steps. In response of thespecific conditions, treatment measures and procedures will have difference. But generallyspeaking, five links are contained:control the situation、verify the facts、take decisivemeasures、guide public opinion and properly handle the remaining problems. And thereare at least3items to be noticed, in which the on-site control is the chief link. Since thecontrol effect relates directly to the development of the entire incident, it’s critical.The fourth part, the author put forward countermeasures in view of the emergencyresponse ability. Though all abilities are need to deal with procuratorial emergency, thefocus of this paper has explained great foresight、resolute decision-making skills andefficient execution. The various characteristics of procuratorial emergency have alsodecided the decision-makers and executants of procuratorial work must possess specialquality and ability, which is the decisive factors and conditions to response effectively anddispose properly.
