At the meantime of providing better experience for users, these newtechnology and function also make the originally closed industrial communication chainbecome more complicated, and put the enterprises into a complex situation with morepatent risks. Under this background, companies start to institute patent proceedings tostrive for market shares. In global market, the tycoons in the sphere of intelligent terminalshave already used patent as a significant weapon to fight for market shares, and enhancedpatent protection to enterprise strategic level. However, as a developing country in thesphere of intelligent terminals, the patent protection of China is still quite undeveloped.We need to depend on overseas help on some core patent, which made us faced with therisk of patent infringement.Under these circumstances, this article uses mobile intelligent terminal as researchobject and tries to analyze the current situation and future prospects of mobile intelligentterminal on the basis of theoretical explanation of the concept and logical structure.Moreover, this essay discusses the existing issues about the patent protection of mobileintelligent terminal in China, and puts forward some useful suggestions to complete thepatent protection system of mobile intelligent terminal for China by learning experiencefrom some successful examples of Apple and Sumsung.In the first place, this article analyzes the market situation of mobile intelligentterminal and patent system. That is, with the rapid increase of mobile intelligent terminal’sglobal market, China has become the largest consumption country. Meanwhile, with thefierce patent competition of mobile intelligent terminal, China is facing with apparentpatent risks.Secondly, this article discusses the current situation of patent protection in China andraises some problems. In front of the fierce global competition, China starts to payattention to the industry research and patent protection of mobile intelligent terminal.However, there still exist some issues, that is, lack of scientific system of patent strategy guiding ideology, imperfection of the patent legal system, deficiency of the patentadministrative mechanism.Then, this article analyzes some successful examples of enterprise patent strategy formobile intelligent terminal of Apple and Sumsung. After that, this essay concludes thatboth these successful methods have some rules in common. That is, they all use basicpatent strategy like patent purchase, patent cross-licensing, patent litigation, which arealso quite helpful for the development of the patent protection of mobile intelligentterminal in China.Ultimately, based on the three parts of analysis of patent strategy modes, this articletries to make some suggestions for the perfection of current patent suggestion of mobileintelligent terminal from three different levels, that is, the level of laws and regulations,the level of government, the level of enterprises. |
