The Study Of Designated Residential Surveillance System

From the announcement of "The Amendment of Criminal Procedural Law (Draft)" in2011,the System of Designated Residential Surveillance has been the controversial focus in the public.As the important part of the current System of Residential Surveillance in the system of coercivemeasures before the judgement, the development of its legislation and jusicatory practice isassociated with the development of Criminal Procedural Law and also the topic of Guarantee ofHuman Rights in China. Although Designated Residential Surveillance System has been amendedmore specific, but it still has some rules which are contradictory with each other, or disjointed tothe reality. This thesis is planed to clear up the details of Designated Residential SurveillanceSystem again and hope it can complete the system which has been valued as an important tool.In this article the perfection of Designated Residential Surveillance System is expounded withproblem-oriented logic clues in four chapters. Chapter1the analysis of current situation ofdesignated residential surveillance system in China, which introduces some details of the newsystem, including the rights and obligations of the suspects, the rules of the decision of DesignatedResidential Surveillance, the rules of implement and the restriction of powers. Chapter2is thecomparison of extraterritorial laws on alternative measures of detention, and the study of it.Chapter3is the theoretical analysis of the Designated Residential Surveillance System, which willtalks about the values, functions and principles of Designated Residential Surveillance System.Chapter4is the suggestion of how to complete the system of Designated Residential Surveillance,which is the perfection of some defects by applying other countries’ rules to some extent.This thesis, on the basis of the past study of Residential Surveillance System, pays closeattention to the System of Designated Residential Surveillance from the microcosmic angle of view.And it gives some feasibility opinions by finding the basic problems. In the future, the System ofDesignated Residential Surveillance may still has some controversies in the public and difficultiesduring the practice, but the author believes that this system will becomes more standardized on thebasis of further investigation.
