With the development of social and the improvement of human civilization,consciousness of human beings protect environment and animal more and moredeepen, the idea of animal proteceion is granted by more and more people.More than100countries have established legal protection system of animal welfare, and havemore perfect development. But our country’s law on animal welfare protection is notperfect, the existing legislation has many problems, and even have many gaps in theprotection of some animal welfare. In recent years, our country has undergone a seriesof animal cruelty event,such as "take bile from live bears","unpin feathers from liveducks "," hurt bear with sulfate ",“Injectingwater to living pigs "," disservice cats"and so on, which attracted the attention of people and have some strong repercussions.Because our country’s law is not perfect, this kind of animal abuse did not getadaption legal punishment, some only condemned by public opinion and moral.Sofrom this, we can know it’s not enough that only rely on folk strength and moralsanction in our society.We should strengthen and perfect the legislation.The first chapter of this paper mainly introduces the concept of animal welfareand animal welfare law, The legal status of animal, and the necessity of concludingthe animal welfare law. The second chapter briefly introduces the origin of animalwelfare law in foreign countries and the development of animal welfare legislation inEurope, the United States and China. Through the comparison on the domestic andinternational situation, find out the gap of animal welfare legislation in our countrywith western developed countries, and draw some useful experience for animalwelfare in china. The third chapter mainly introduces some ideas on the constructionof animal welfare legislation, including the purpose of legislation, legislativeprinciples and should give what welfare for different kinds animals.This paper aims to improve and promote the legislation of animal welfare in ourcountry, elevate the animal welfare protection consciousness of the citizen,and makeour legislation have a same level with the international community. The ultimate goal still is improve relationship between human and nature, maintain the ecologicalbalance, and promote the sustainable development of harmonious society.
