The Study Of Operating Right Of Taxi Industry

From1980s to the present, in this short30years, the taxi industry has gonethrough an enormous change. This change not only reflects the benefits of the marketdirected economy system, but also reflects the great development of people’s lifefrom reformation. However, with the continuous expansion of the scale of theindustry, there are various contradictions inside the industry. Especially in the pastfew years, the taxi industry group events come and go, intensify the socialcontradictions, and also planted many unstable and unharmonious seeds of the social.This undoubtedly brings about great damage to the interests of masses of the people.In this paper, we found that the fundamental contradiction of the taxi industry isattributed to the inaccuracy of the government’s definition of the operating right andthe relation between everybody, so that the operate management of operating right isnot adapted to the law of the market directed economy system. Therefore, this articlewill regard the current industry model and exposed drawbacks as the logical startingpoint, the definition、characteristics、basis and law nature as the heart. And at last thearticle will give some suggestions to solve the contradiction. This paper is dividedinto four parts:Firstly, the paper will introduce the current operating models to expose theproblems of the operating right. And this part will be the logical starting point of thepaper.Secondly, we will analyse the nature and the legal basis of operating right in theacademic way to prove the legal characteristics of the taxi operating right.Thirdly, based on the study of the previous chapter about the taxi operating rightand combined with the characteristics of the industry, this part will try to introduce the right in practical way to prove the dual necessity of the market-directedoperating and the government regulation.Fourthly, based on the previous three chapters, this part will answer the problemsof the operating right and give some suggestions to the reformation of the operatingright.
