The Study Of Legal Regulation Of Taxi Operating Model

After the reform and opening of China, along with the establishment of a market economy, the social economy has made great progress. At the same time, people’s living standard has gradually improved and public transport demand is also increasing.In this stimulating environment, urban taxi emerged and become a key part of the urban passenger transport system. Taxis became popularity of non-expensive and gradually developed to be used by ordinary people. With the increasing number of the taxi, the taxi industry has become chaos, many problems have become increasingly prominent, local policies and regulations have been introduced to regulate it. Currently diversified development trend of the domestic operating model of the taxi industry, in all the cities, the majority is a model-based legal situation in a city, and the case of multiple models coexist. Situation from various cities of nationwide taxi industry point of view, no matter what model of operation of the law,it will bring mass incidents, the transport strike storm always come and go. In 2002 and 2012, Lanzhou taxi industry broke out two large-scale events, the causes and conflicts may be different to other cities, but it is inseparable both the model of taxi operations and the system of taxi franchise essentially.Therefore, from the perspective of the legal system analysis the model of taxi operations and strengthening of the legal system study of the taxi industry have the importance of legal theory and practice.Firstly, the basic concepts of the taxi industry is a logical starting point,the concept of taxi,taxi franchise, the taxi industry and the subject related to the taxi industry are defined.Especially the right to operate a taxi and the taxi industry legal attributes and characteristics were analyzed,explores the concept,history and current situation of taxi operation mode.Secondly, based on the research of the model of the taxi operating, in this paper the history and present situation of Lanzhou City taxi industry about its operating model, focuses on the legal regulation flaws of Lanzhou taxi industry operating mode. Again, on the basis studying of extra-territorial legal taxi operators model, discusses the enlightenment sense of extraterritorial legal model taxi operators. Finally, based on the above studies, measures to improve the operational mode of Lanzhou taxi industry.From the history of Lanzhou taxi industry perspective, there is a obvious drawbacks about the traditional model, these problems are seriously affecting the development of the local taxi industry and cities. From a practical point of view, the relevant government departments have the agenda of taxi reform put in Lanzhou city reform. The author believes that the reform of the taxi industry needs to be combined with the actual situation of the taxi industry and draw on the legal system of regulation and management experience in domestic and international success, while respecting the objective laws of the market on the basis of economic development,we need to establish and improve the relevant legal system of the taxi operators,appropriate to relax the number regulation of the taxi market. At the same time, weshould pay attention to the development of normal government organization and to balance the interests of government, business and taxi drivers.
